Elder Injury & Abuse

Protecting Those Who
Cannot Protect Themselves

Our team has been handling cases related to elder abuse for over 15 years, successfully resolving numerous elder neglect cases through both litigation and mediation.

We have authored appellate court briefs resulting in appellate court decisions that have protected the rights of the elderly — establishing precedent that reaches far beyond any single case.

We represent elders who have sustained injuries due to neglect or abuse in nursing homes, board and care facilities, and assisted-living facilities — and those who have sustained elder transportation injuries.

California's Elder Care Crisis

The Scale of the Problem
Demands Accountability

According to the State of California Department of Justice, California's nursing facilities face a systemic failure that puts tens of thousands of vulnerable residents at risk each year.

In California, approximately 225,000 cases of elder abuse occur every year. Experts estimate that for every case reported, as many as five go unreported.
1 in 5
Understaffed Facilities

The Office of Statewide Health Planning and Development reported that one-fifth of California's nursing facilities did not meet state-mandated requirements for staffing levels.

2×
Physical Restraint Rate

In 2006, Centers for Medicare and Medicaid Services reported that twice as many of California's 115,000+ nursing home residents are placed in physical restraints compared to the national average.

⅔
Deficiencies Causing Harm

From 2001 to 2005, California DHCS found that two-thirds of all reported deficiencies caused or could have caused significant harm — more than half of all complaints related to poor quality of care.

California Department of Justice Summary

"Together, these staggering statistics and projections illustrate the urgent need to address and remedy the poor quality of care in many of California's skilled nursing facilities."

"In California, approximately 225,000 cases of elder abuse occur every year. Sadly, experts estimate that for every case of elder abuse and neglect that is reported, there may be as many as five cases that go unreported."

Common Questions

Frequently Asked Questions

Answers to the questions families most often bring to us when a loved one may have suffered elder abuse or neglect.

What types of facilities can be held liable for elder abuse?
We represent elders who have sustained injuries due to neglect or abuse in nursing homes, board and care facilities, and assisted-living facilities. We also represent those who have sustained elder transportation injuries. Any care environment where your loved one was entrusted to professional staff creates a duty of care — and a potential avenue for legal accountability when that duty is breached.
What are the signs that my loved one may be suffering abuse or neglect?
Key warning signs include bed sores or skin ulcers, unexplained bruising, choking incidents, falls, fractures, head injuries, improper diet and dehydration, improper physical restraints, lack of cleanliness, neglect or lack of proper supervision, overmedication or administration of incorrect medication, untreated infections, and unexplained weight loss. If you observe any of these signs, contact our office immediately.
What is the Elder Abuse Statute and how does it help my case?
California's Elder Abuse and Dependent Adult Civil Protection Act provides enhanced remedies beyond ordinary negligence law. When a facility or its owners engage in recklessness, oppression, fraud, or malice, the statute allows for exemplary (punitive) damages, attorneys' fees to be paid by the violator, and civil penalties. Our team has deep experience invoking these protections on behalf of injured elders and their families.
Can I bring a wrongful death claim if my loved one passed away?
Yes. If your elder family member died as a result of neglect or abuse in a care facility, you may have a wrongful death claim. Recoverable damages include loss of care, comfort and companionship, and economic loss to heirs. Our firm handles wrongful death cases arising from elder abuse with the same rigor and compassion we bring to all our elder injury work.
How does your fee structure work?
We operate on a contingency fee basis — No Recovery, No Fee. You owe nothing unless we obtain a recovery for you. Additionally, under the Elder Abuse Statute, in qualifying cases the violating facility may be required to pay your attorneys' fees directly, further protecting you from out-of-pocket legal costs.
Why does elder abuse go unreported so often?
Experts estimate that for every case of elder abuse and neglect that is reported, there may be as many as five cases that go unreported. Elders often fear retaliation, lack the ability to communicate, or do not have advocates present to identify the signs. Family members may not know what warning signs to look for, or may not realize that what they are witnessing constitutes abuse. That is why legal representation and informed advocacy are so critical.
